La loi prévoit que les organisations liées par une convention de branche ou, à défaut, par des accords professionnels doivent se réunir pour négocier sur les salaires lorsque le salaire minimum national professionnel des salariés sans qualification est inférieur au SMIC.

Désormais, la partie patronale dispose de 45 jours (contre 3 mois auparavant) pour engager la négociation, à défaut de quoi les organisations syndicales de salariés représentatives pourront en prendre l’initiative.

Le Ministre du Travail pourra engager une procédure de fusion des branches en raison de la faiblesse du nombre d’accords ou avenants signés, notamment ceux assurant un salaire minimum national professionnel au moins égal au SMIC.
