Rappel des dispositions légales

La présente publication rappelle les nouvelles dispositions concernant le congé de paternité et d’accueil de l’enfant, suite à la publication de la loi de financement de la sécurité sociale pour 2021.

En application de l’article 73 de la loi n°2020-1576 du 14 décembre 2020 de financement de la sécurité sociale pour 2021 et au décret n° 2021-574 du 10 mai 2021, à partir du 1er juillet 2021 le congé de paternité et d’accueil de l’enfant évolue comme suit :

Durée

Sa durée est augmentée, elle est désormais de 25 jours contre 11 jours auparavant ;
Cette période de 25 jours s’ajoute aux 3 jours de congé de naissance financés par l’employeur.
En cas de naissances multiples, la durée est aussi augmentée : elle est portée à 32 jours indemnisés par la sécurité sociale contre 18 auparavant.
