Principe majeur

La rupture du contrat de travail du fait de l'employeur ouvre droit, pour le représentant payé en tout ou partie à la commission, à une indemnité de clientèle ayant pour objet de réparer le préjudice que subit celui-ci en perdant pour l'avenir le bénéfice de la clientèle qu'il a créée, apportée ou développée.

Conditions d'attribution

Le VRP statutaire peut prétendre à l'indemnité de clientèle si les conditions suivantes sont remplies :

Le contrat à durée indéterminée est résilié par lefait de l'employeur ou cesse par suite d'accident ou de maladie entraînant une incapacité permanente totale de travail ;
Si le contrat est un CDD suite à une rupture anticipée par l’employeur, ou n’est pas renouvelé à son terme ;
La rupture n'est pas provoquée par unefaute grave du représentant ;
Celui-ci justifie avoir apporté, créé ou développé uneclientèle dont il est privé pour l'avenir du fait de la rupture du contrat.
