Principe et objectif

Ce droit particulier peut être prévu par une clause du contrat de travail, peut être par une disposition de la Convention collective.

Le salarié utilise donc un véhicule de l’entreprise pour réaliser son travail et éventuellement pour un usage personnel (ce qui constituera en l’espèce un avantage en nature considéré comme un élément accessoire de la rémunération).

Conditions de validité ?

Cette clause particulière du contrat de travail est à l’origine de nombreuses affaires jugées par le Conseil de prud’hommes.

Il convient donc d’agir avec prudence et de tenter d’anticiper au mieux les différents cas de figure envisageable.
