La rupture conventionnelle avec un salarié en arrêt maladie est-elle possible ?

Oui. Une circulaire du 17 mars 2009 a précisé que dans « les cas de suspension du contrat ne bénéficiant pas d’une protection particulière (congé parental, congé sabbatique, congé sans soldes, etc…) aucune disposition n’interdit aux parties de conclure une rupture conventionnelle ».

Même si la circulaire ne le précise pas expressément, la rupture conventionnelle pendant un arrêt maladie non consécutif à un accident du travail ou une maladie professionnelle est en théorie possible.

Le consentement du salarié doit avoir été donné de façon libre et éclairée.
