Le règlement européen vous impose d’informer vos salariés, de manière claire et précise, sur le traitement de leurs données personnelles. En revanche, aucun formalisme particulier n’est prévu. Cette information peut se faire par tout moyen. En cas de contrôle, vous devez être en mesure de prouver que vos salariés sont bien informés en la matière.

Vous pouvez diffuser l’information par le biais d’une note de service affichée sur les panneaux destinés à la communication avec le personnel, du livret d’accueil des nouveaux embauchés, de l’intranet de l’entreprise, etc…

Par ailleurs, nous vous conseillons de présenter cette information et son mode de diffusion aux représentants du personnel lors d’une réunion ordinaire, de mettre le sujet à l’ordre du jour et de le retranscrire dans le procès-verbal de réunion.

Ce modèle est à adapter en fonction des spécificités de chaque entreprise.

Qu’est-ce-que le RGPD ?

Le RGPD (Règlement général sur la protection des données) du 27 avril 2016 est un acte législatif européen relatif à la sécurité sur les réseaux informatiques, applicable au 25 Mai 2018.

Son objectif est d’assurer la protection des données à caractère personnel des citoyens européens : salariés, candidats à un emploi, clients, prospects, fournisseurs, partenaires commerciaux, patients, etc…

Il s’agit notamment de :

Lutter contre le vol de données personnelles via internet et les réseaux informatiques : détournement d’adresses mail, diffusion de fichiers malicieux, vol de coordonnées bancaires, rançon-logiciels, vol de cookies de navigation, etc… ;
Renforcer le droit des personnes et leur donner un contrôle sur leurs données personnelles ;
Responsabiliser les entreprises et professionnels ;
Augmenter la coopération entre les autorités protectrices de données personnelles au sein de l’Union Européenne. En France, cette autorité est la CNIL.
