Les formalités de dépôt communes aux accords d’entreprise doivent être effectuées pour l’accord de performance collective.

L’accord collectif d’entreprise conclu et dûment signé par chacune des parties doit ensuite être notifié aux organisations syndicales représentatives, puis déposé et publié dans les règles. A défaut, il sera réputé non écrit et ne pourra pas être appliqué.

L’information des salariés

L’employeur doit communiquer aux salariés, par tout moyen, le lieu et les modalités de consultation de l’accord.

L’APC peut prévoir des modalités spécifiques d’information des salariés.

La notification de l’accord aux organisations syndicales

L’accord signé doit être notifié aux organisations syndicales représentatives. Celles-ci disposent d’un délai de 8 jours à compter de la notification pour exercer leur droit d’opposition.
