La présente fiche pratique aborde le régime fiscal et social de l’indemnité versée dans le cadre d’une rupture conventionnelle (individuelle ou collective), selon les conditions en vigueur en 2024 suite à mise à jour du BOSS du 16/08/2023.

Rappel du régime avant LFSS rectificative pour 2023 (pour information)

Le régime fiscal et social diffère selon que le salarié concerné :

Remplit les conditions permettant de bénéficier d’une pension de retraite ;
Ne remplit pas les conditions permettant de bénéficier d’une pension de retraite.

Le régime social avait ainsi été grandement modifié au 1^er janvier 2013.

Les indemnités versées dans le cadre d’une rupture conventionnelle sont désormais soumises au forfait social, au taux de 20%, pour la part exclue de cotisations sociales.

Extrait de la LFSS pour 2013 :

2o Avant le dernier alinéa, il est inséré un alinéa ainsi rédigé :

« Sont également soumises à cette contribution les indemnités versées à l’occasion de la rupture conventionnelle mentionnée aux articles L. 1237-11 à L. 1237-15 du code du travail, pour leur part exclue de l’assiette de la contribution mentionnée à l’article L. 136-1 du présent code en application du 5o du II de l’article L. 136-2. »

– Au début de la première phrase du 5o du II de l’article L. 136-2 du même code, sont ajoutés les mots :

« Indépendamment de leur assujettissement à l’impôt sur le revenu, ».
